Court orders firm to reinstate sacked pair

The Industrial Court has reinstated two Nakuru Water Sewerage and Sanitation Company workers who were unlawfully dismissed three years ago.

Zephania Nyambane and Francis Makokha were sacked by the water company for allegedly leading a strike, which stalled its operations.

The two, who are branch officials of the Kenya Local Government Workers Union, had asked the Industrial Court to order their reinstatement after the company sacked them following a strike in November 2010.

The Industrial Court also ordered the company to pay salaries and benefits backdated to three years.

Justice Bryam Ongaya found the company to have wrongfully dismissed the two workers without following due process.

Ongaya, in his ruling, noted that the water company failed to produce evidence of investigations into the two at the time of termination.

He also held that there was no evidence showing that the disciplinary letters were delivered to the two workers before the company sacked them.
