The fate of suspects of the post elections violence now lies with the International Criminal Court.

Chief Mediator and former UN Secretary General Kofi Annan has forwarded the envelope containing the list of perpetrators of last years post election violence to the ICC.

Annan has informed both President Kibaki and Prime Minister Raila Odinga of the decision of the African Union panel of Eminent African personalities to forward the envelope to the ICC prosecutor.

"The Panel made this decision in light of the recent agreement reached by ICC prosecutor, Luis Moreno-Ocampo, and the delegation of the Government of Kenya comprising the Justice Minister Mutula Kilonzo, Lands Minister James Orengo, and Attorney General Amos Wako, July 3 2009,"said Annan.

Speaking from Geneva, Mr Annan "welcomed the Government of Kenya's renewed efforts to implement the recommendations of the Waki Commission and to establish a Special Tribunal."

He added: any judicial mechanism adopted to bring the perpetrators of the post-election violence to justice must meet international legal standards and be broadly debated with all sectors of the Kenyan society in order to bring credibility to the process."
