KAA now cites public interest as it cancels Adani deal

[AFP] The government has terminated a multi-billion-shilling deal with the Adani Group to refurbish Jomo Kenyatta International Airport (JKIA). The decision, detailed in a one-page letter from the Kenya Airports Authority (KAA) to Adani's representative Alok Patni, cites failure to meet public interest standards due to significant governance issues. Acting KAA Director Nicholas Bodo authored the letter, which was filed in court, signaling the end of the controversial Public-Private Partnership (PPP) project. "The decision follows an assessment during which it was determined that the project does not meet the public interest criteria due to material governance concerns that have arisen during the procurement process." President William Ruto, addressing Parliament, attributed the cancellation to new evidence uncovered by investigative agencies and partner nations. "In the face of undisputed evidence or credible information on corruption, I will not hesitate to take decisive action," Ruto said. The deal, which had sparked public outcry and legal challenges, faced scrutiny over transparency and its potential impact on Kenya's sovereignty over its main aviation hub. The cancellation follows a lawsuit filed by Tony Gachoka, the Jubilee Party, Wiper Party, DAP-K, Mount Kenya Jurists, and Issack Lango Guyo. In response, Bodo urged Justice Bahati Mwamuye to dismiss the case, arguing it was now moot since the deal had been scrapped. He maintained that when the petition was lodged, the Adani proposal was still under review. "The petitioners' allegations that the respondents had alienated JKIA were premature, based on misrepresentation of facts, and unripe for determination," Bodo argued, adding that the court lacked jurisdiction from the outset. Bodo denied claims that JKIA had been leased to the Indian conglomerate, emphasising that the government had only explored the PPP model to address the airport's urgent need for expansion. While Bodo's letter to Adani cited governance concerns as the reason for cancellation, his court response painted a broader picture of JKIA's needs and the government's intent. The apparent contradiction - canceling a deal for public interest yet defending its necessity - reflects the delicate balance between economic pragmatism and public accountability. He highlighted JKIA's critical role in Kenya's economy, noting that upgrading its infrastructure was "no longer a luxury but an emergency need." He pointed out that JKIA's passenger traffic increases by one million annually, a growth that could generate 10,000 jobs with proper investment. Bodo cited global examples of successful PPP-funded airports, including John F Kennedy in New York, Medina in Saudi Arabia, Los Angeles International, Rwanda's Bugesera, Istanbul, and LaGuardia. "In Latin America alone, 90 airports were built under such a scheme," he argued. The government had promoted JKIA's expansion as an investment opportunity during Ruto's state visits to the US, France, Germany, South Korea, India, China, Saudi Arabia, and the UK. However, the Adani deal faced fierce opposition from citizens and civil society, who raised concerns over governance, cost, and the risk of ceding control of a strategic national asset. Critics questioned the procurement process's transparency and Adani's track record, amplifying public distrust. For now, the termination leaves JKIA's future upgrades in limbo, with the government yet to outline an alternative plan.As Kenya grapples with financial constraints and rising passenger demand, the scrapping of the Adani deal underscores the challenges of balancing infrastructure development with public trust. Whether this marks a victory for accountability or a setback for progress remains a subject of debate.
