Doctor charged for defrauding his father

Dr. Onentiah Magare was charged before Milimani Chief Magistrate Francis Andayi for allegedly defrauding his father Joshua Gichana the land measuring 0.9 Hectares at Green Fields, Donholm, Nairobi County.

A man has been accused of trying to steal a Sh20 million piece of land from his father.

Onentiah Magare, a senior official at the Ministry of Health, is alleged to have defrauded his father Joshua Gichana the land measuring 0.9 hectares in Donholm, Nairobi.

Mr Gichana said Dr Magare conspired with his mother to steal the land.

Magare was also charged with forgery. It is claimed that he forged a letter dated February 28, 2011 authorising him to transfer the lease title.

The court battle now pitting son and father started with Magare's mother Mary Moraa. It is alleged that it is Ms Moraa who helped his son access the transfer document that he later forged.

“On or before March 5, 2011, at unknown place within the Republic of Kenya, with intent to defraud Joshua Chiefta Gichana, Dr Magare forged a letter purporting it to be a genuine document of authority to transfer lease title signed by the said Joshua Chiefta Gichana,” read the charges.

Gichana, a retired chief accountant who worked with the Foreign Affairs ministry, disowned his son in court. He said in court documents that Magare was not his biological son.

At the same time, Magare is faced with a separate charge of obtaining land by false pretence.

It is claimed that he fraudulently registered the contested land to himself in a certificate of lease dated December 21, 2011.

Magare denied the charges. He was released on a Sh1 million bond with an alternative cash bail of Sh500,000.
