Court has no powers to unseat nominated MP Robert Mutua

Wiper Democratic Movement nominated MP Robert Mutemi Mutua will retain his seat, the High Court ruled Monday.

Justice Isaac Lenaola concluded that any challenge to the nomination of an MP could only be done by way of an election petition and not a constitutional petition.

He said the High Court had no jurisdiction to declare the position Mr Mutua holds vacant.

David Muriuki Ndwiga had challenged Mutua's nomination on the grounds that he was not a member of the party.
