Naivas MD accuses kin of forging will

Naivas Supermarkets Managing Director David Kimani Mukuha has accused his elder brother of forgery.

Mr Kimani told the court that his brother, Newton Kagira Mukuha, produced a forged will in a succession case.

Kimani, who was testifying before Justice Anthony Ndungu submitted that his father and founder of Naivas - Peter Mukuha Kago - drafted a will before he died in May 6, 2010.

He said the will presented by Mr Kagira, who is opposed to the administration of the multi-billion-shilling retail chain, was forged and accused him of plotting to reap where he never planted.

"My father's property should be distributed in accordance with the will he left behind. Even my elder brother Kagira received his share of the property," Kimani told Justice Ndungu.

He further submitted that Kagira had run down a number of investments handed over by the family including the Rongai self-service store in Nakuru.

"He is the only one opposed to the will. My father summoned us to a meeting on March 20, 2010 where he revealed the will," Kimani said.

Kagira is demanding a 20 per cent stake in the Naivas supermarket chain, and accuses his siblings of blocking him from inheriting his father's multi-billion-shilling estate.

He claims his younger brother, Simon Gachwe, is unfit to be the estate administrator and wants an executor of the will appointed.
