The importation of generic drugs for people living with HIV and Aids will be affected following President Kibaki’s decision to assent to the Anti-Counterfeit Act in 2008.
Three people using anti-retroviral drugs and a non-government organisation — Aids Law Project — moved to court yesterday, arguing enforcement of the Act would endanger their lives.
Their advocate Ombati Omwanza told the court people on ARVs would be arbitrarily denied access to affordable and essential medication necessary for their fulfillment of the right to life as enshrined in the Constitution.
"The generic drugs for the treatment of HIV and Aids that the petitioners are using currently are easily available and affordable compared to the branded version," he argued.
But Attorney General Amos Wako asked the court to dismiss the application on grounds it is incompetent.
