Football Kenya Federation's (FKF) Annual General Meeting set for August 28 could be still-born if the legal hurdles mounted by a section of the executive opposing it go through.

The AGM, which was to take place in Kisii on June 29 was called off amid acrimonious exchanges, with top federation officials citing security risks while others, including local police chiefs, denied the existence of any such security threat.

Nyanza National Executive Council member Tom Alila and Doris Petra, who have lately fronted dissenting voices within the federation, have, through law firm Orego & Odhiambo Advocates, stated they were not consulted as alleged in the notice calling for the (August 28) AGM.

"Vide a notice dates 20th June 2015 you have purportedly convened the Federation's 3rd Annual General Meeting to be held at Nairobi on 28th August 2015," they said in a letter to FKF General Secretary dated July 7.

"In the letter dates 29th June 2015, you have stated that the decision to convene the Annual general Meeting was made by the Federation's National Executive Committee. However, the date and place of the Committee Meeting has not been stated.

"The General Meeting was convened after the one scheduled for Kisii on 26th June 2015 was called off by yourselves in contravention of the Federation's constitution.

"We further wish to state that our clients are members of the Federation's National Executive Committee. At no time did they attend neither were they invited to any National Executive Committee meeting that set the date for a General Meeting to be held on 28th August 2015.

"It is beyond peradventure that in accordance with Article 26 (2) the federation's constitution only the National Executive Committee shall fix the place and date of the Annual general Meeting. The constitution at Article 33 (3) provides as follows:

"The National Chairman shall compile the agenda. Each member of the National Executive Committee is entitled to propose items for inclusion in the agenda. The members of NEC must submit the points they wish to be included in the agenda for the meeting to the general secretariat at least seven days before the meeting.

 

CLIENTS' OBJECTION

"The purpose of writing this letter is therefore to "strongly express our clients' objection to the notice convening the annual general meeting, the same having been done without their participation and in utter disregard of Articles 26 (2) and 33(3) of the Federation's constitution;

"To demand that you furnish us with the notice convening the National Executive Committee that fixed the place and date of the said 3rd Annual general Meeting to be held at Nairobi on 28th August 2015. We also demand copies of the minutes of the National Executive Committee meeting.

"To put you on notice that should you proceed with the purported annual general meeting on 28th August 2015, we shall be constrained to take such appropriate measures as to protect our clients' interests," they said.

FKF General Secretary, Michael Esakwa denied knowledge of the planned court case. "No I am not aware (of the letter)," he told FeverPitch.
