The Court of Appeal in Kisumu has upheld the decision by the High Court quashing the election of Homa Bay governor Cyprian Awiti.
This follows a successful petition by Kasipul MP Oyugi Magwanga in which it was established that the Independent Electoral and Boundaries Commission (IEBC) did not conduct a free and fair election in Homa Bay.
In a three-judge bench ruling which was read by, Justice Fatuma Sichale, Mr Awiti was ordered to pay Sh4 million and IEBC Sh2 million to Mr Magwanga as costs of the case.

Cyprian Awiti losing his seat as the Homa Bay County Governor is the best thing that has happened to my county since 2013 general elections. This is the only county that is yet to enjoy any fruit of devolution since the promulgation of the new Constitution in August 2010. #043
