Why police cannot act on Senator Moses Wetangula or his wife yet

Bungoma Senator Moses Wetang’ula and his wife Ann are yet to return the police P3 forms which are integral to their assault complaints.

The couple accused each other of assault and separately wrote statements with the police last month.

Authorities have said that the couple is yet to return the forms as per the law to warrant action.

Head of the Directorate of Criminal Investigations (DCI - Karen Division) Kenneth Njoroge said he had not seen the two after their case was moved to the station.

“We can’t take action on what we have not seen. They have not come back with the forms, and we cant force them,” he said.

Ann was the first to record her statement at Lang’ata Police Station on February 21.

She stated that her husband had beaten her on the night of February 18 and she sustained injuries on both hands, her chest and legs and that she was treated and discharged at the Karen Hospital.

On the same day, Mr Wetang’ula went to the station and accused his wife of assaulting him.

The case was later moved to the Karen DCI office. 

“On February 21, 2016 at around 1150hrs, Ann Wetang’ula, a resident of Karen, came to the station and reported that on February 18, 2016 at around 9pm she was assaulted by her husband, Moses Wetang’ula, Senator for Bungoma County. She complained of having sustained injuries on both hands, chest and legs. She was treated at Karen Hospital and discharged,” reads a letter referring the case to the Karen DCI.

It added: “On the same day at around 1830hrs, Wetang’ula, a resident of Mahugu Court on Karabon Road in Nairobi, also came to the station and reported having been assaulted by his wife on February 18, 2016 at around 9.30pm at their home in Karen.”

Wetang’ula had accused his wife of infidelity. That is when, according to him, his wife became furious and attacked him. As a result, he said, he sustained injuries on his head, left hand, left leg and chest. He was treated at Karen Hospital and issued with a P3 form.

When one is issued with a P3 Form, they must return it to the police for action.

Attempts to get comments from both Wentang’ula and his wife were futile.

Police said they are waiting for the concerned parties to return the P3 forms for them to take action.
