Raphael Tuju’s wife Ruth Akinyi charged for assaulting watchman

The estranged wife of former Rarieda Member of Parliament Raphael Tuju is embroiled in the corridors of justice as she was arraigned in Court to face a criminal case of assault against a watchman. Ruth Wanjare Akinyi pleaded not guilty to charges that on  August 23, 2013 at Localine Garden in Upperhill within Nairobi County, she assaulted Felix Omondi Obuodha.

She was charged with assaulting a night watchman and causing bodily harm contrary to section 251 of the penal code.

The watchman was examined by a police doctor and issued with a P3 Form to record injuries after the incident.

Mr Omondi, a guard at Lacoline Gardens along Masaba Road, was examined at Nairobi Traffic Area where the doctor indicated that he had suffered injuries on the left leg with bruises on left thigh and upper left limb.

She was charged before chief magistrate at Milimani law courts, but pleaded not guilty to the charges.

Her lawyer Ian Mbugua applied for a cash bail and requested the court to grant him access to witness statements and any evidence the prosecution may want to use.

During the court session, Akinyi covered her head even as the members of the press attempted to take her pictures in the dock.

The doctor’s reports indicated  that the watchman suffered chest injuries when he fell on the ground following the Friday night incident.

Omondi recorded statements at the Capital Hill police station, he claimed that Akinyi drove into the gate while he was opening and knocked him down causing him bodily harm.

The guard reported that Akinyi who also stays at the apartments did not bother to check his status and was given first aid by another tenant who came to his rescue.

Akinyi has denied to knowingly hurting the watchman and claims she simply hit the gate to escape from suspected robbers who were trailing her as she returned home.

 She claimed that she was attacked and yet the watchman was slow in opening the gate.

However, the guard reported the incident to his bosses and proceeded to the police where he recorded a statement.

Akinyi was granted a cash bail of Sh50,000 and the case set for hearing on  November 28.
