
A Primary school teacher accused of defiling and impregnating a 17-year-old virgin has been set free by the High Court in Nyeri.
George Mwangi Murungi landed in court in September 2015 after he was accused of defiling the said minor within Nyeri County.
In the alternative charge, Murungi was charged with committing an indecent act with a child contrary to the law.
The trial court found him guilty of the principal count and sentenced him to serve 15 years in prison.
Murungi, however, appealed the conviction citing inadequate evidence.
The minor testified that the teacher lured her into his house and had sexual intercourse with her for three hours, an ordeal she kept to herself.
A few months later, she fell ill, upon which she decided to visit a hospital. A pregnancy test conducted on her turned positive — she was 13 weeks pregnant. It was then that she told her mother what had allegedly transpired between herself and the Murungi on September 16, 2015.
She attributed the pregnancy to Murungi — and denied that anybody else could have been responsible. She claimed she had not been in any relationship with anybody else of the opposite sex save for Murungi.
Murungi gave sworn evidence when he was put on his defence, and denied committing the offence.
High Court Judge Jayrus Ngaa partly concluded in judgment delivered on May 15 that: “The ultimate conclusion that I have to come to is that the appellant’s appeal has merits, and I hereby allow it; the appellant’s conviction is quashed and the sentence meted out against him set aside. He is set at liberty unless he is lawfully held.
