Lawyer wants Anthony Chinedu produced in court

Nairobi, Kenya: A lawyer representing the deported Nigerian linked with drug trafficking has moved to the high court seeking to have him produced in court in an on-going case.

Nelson Havi is set to appear in court Thursday morning seeking to compel the government to produce the Nigerian in court in compliance with an order issued by Justice Musagha Mbogoli.

Havi in an application dated June 3, quoting sections of the constitution and criminal procedures code had applied to have Anthony Chinedu produced in court.

“Take notice that any party served with the orders and disobeys the same shall be guilty to contempt of court and liable to imprisonment,” Principal Deputy Registrar of the high court.

Havi had moved to court seeking to have Chinedu produced in court and also being set free.

The counsel had argued that the Nigerian had a case pending before the high court in which he had sought an order to prohibit his deportation from the country on the grounds that he was in the country illegaly.

The lawyer added that Chinedu had another suit in the magistrate court where he was accused being in the country illegally contrary to the immigration Act.

Chinedu he added had been released on a cash bail of Sh200,000 pursuant to an Order made on April 23, 2013 in Criminal Case No. 501 of 2013. The case comes up for hearing on 1st July, 2013.

In an earlier case Magistrate Kiarie Waweru had rejected an application for bail saying the prosecution had laid down “reasonable circumstances” for further holding of Mr Chinedu and granted the prosecution two days to complete investigations.

Anthony Chinedu was charged with drug trafficking but before the case was finalised he was deported alongside six other Nigerians for being in the country illegally.
