Fongo had been charged with raping two women in his Kihoto house in Naivasha, between August 8 and 14 2008.
He faced two more charges of kidnapping the two women on August 8 and 9 respectively with intent of murdering them.
The last charges stated that between August 8 and 14 2008, he assaulted the women occasioning them actual bodily harm.
It was mixed reaction for area residents as Naivasha senior principal magistrate Thripsisa Wamae threw the ball to the prosecution.
The magistrate noted that despite one of the victims testifying about the horrors she underwent in the hands of the accused the prosecution had not availed any medical evidence.
In mitigation, the accused who looked composed asked for leniency with the prosecution terming him a first time offender.
He was driven under tight security back to the Nakuru Law courts where he is facing a separate murder charge.
Last week the accused who was unrepresented was acquitted on three other charges of rape, assault and kidnapping after the second complainant failed to testify despite various sermons.
