Steve Mbogo lost in bid to access election materials

City politician Steve Mbogo has lost his bid for scrutiny of all the votes cast in his favour on August 8 last year.

A court declined to issue the orders requested by Mr Mbogo in a petition challenging Charles Njagua's election as Starehe MP.

While delivering the ruling, Justice Fred Ochieng yesterday said Mbogo had not made a case to warrant the production of diaries for all the polling stations.

“I find that the Independent Electoral and Boundaries Commission (IEBC) cannot be faulted for not making available all the polling station diaries. I also find no reason to warrant an order compelling IEBC to make available all the polling diaries which it had not already provided,” ruled Justice Ochieng.

Mr Mbogo had made the application on October 5, 2017.

The application had sought the scrutiny of votes cast in 25 polling stations among them being Peter Clavers Primary School, Pangani Girls High School, Moi Avenue High School and Mukuru Kaiyaba.

He also sought orders to compel the IEBC to supply him copies of original Forms 35A from all the 254 polling stations the constituency.

Mbogo also sought to have a certified copy of Form 35B for Starehe constituency.

But the judge ruled that the petitioner did not make out a case.

The petitioner had argued there were three sets of results that differed with those on Form 35B and the online portal.

Mbogo argued the three sets of results constituted evidence of vote manipulation.
