Nairobi, Kenya: Nairobi Senator Gideon Mbuvi alias Sonko has testified in a case in which Sinai fire victims are seeking compensation from the Government.

Mbuvi appeared before Justice David Majanja to give his witness account of September 12, 2011 fire tragedy that killed about 100 people and left a similar number injured.

In the case, Kenya Pipeline Corporation (KPC) is accused of negligence and disregarding the welfare of victims by constructing an oil pipeline in the middle of a residential area.

KPC, is accused of not putting firefighting facilities in place and ignoring the danger it posed to the inhabitants of Sinai.

Two weeks ago, the politician turned emotional after judge David Majanja, who was set to take his evidence, put off the matter until February 13. The case had been adjourned because Kenya Pipeline Corporation, the State Law and National Environmental Management Authority (Nema), who have been named as respondents, were yet to be served with witness statements.

Yesterday, Mbuvi accused the Government of being negligent. He said Government ought to have dug trenches and ensured that the oil pipeline that passes through the slum was  well maintained.

“I was called at around 10:00 am and immediately called the fire brigade and the police,” he recounted.

The former Makadara Constituency MP described the incident as “ugly”. “Bodies were littered all over the place, some belonging to animals and children,” he said.

The Nairobi senator also blamed the now-defunct Nairobi City Council for failing to construct roads, supply water and/or any infrastructure, making the area inaccessible.

The witness said the fire could have been controlled if roads were available. High Court also heard that the fire brigade could not access the area where fire began.

Mbuvi further said was ready to table before the court evidence in form of audio-visual, which was gathered by his team. The hearing will continue on March 10,11 and 12th this year.
