Kakamega Court to rule on Senator Boni Khalwale

Senator Boni Khalwale share a word with Senator Mosses Wetang'ula and other legal minds during mentioning of his case in a Kakamega court on May 27th, 2016.

A Kakamega court will tomorrow rule on whether Senator Boni Khalwale and his bodyguard Washington Mzozo will face 'retrogressive' charges for participating in a protest.

The charge "rioting after proclamation contrary to section 83 of the penal code" attracts a life sentence, if convicted.

The two were arrested last Monday during anti-IEBC demonstrations.

Some 15 advocates, including CORD co-leader Moses Wetangula, had applied for dropping of the charge, which they claimed was last used in 1952 by the colonial government against Mau Mau fighters.

State counsel Peter Mailenyi had contested the review of the charge.

Kakamega Senior Principal Magistrate Samuel Wahome failed to deliver a ruling last Friday.
