I have fresh evidence indicating that Tunoi received Sh200m, says MP Waititu

Mombasa, Kenya: Waititu said that he had fresh evidence indicating that Tunoi received 200 million to declare Kidero as the governor.

Kabete MP Ferdinand Waititu has called for the chief justice willy Mutunga to probe into new evidence and allegations that supreme court judge justice Philip Tunoi received a 200 million bribe that influenced him to declare  Evans Kidero as the governor of Nairobi County.

Waititu who was addressing the press in Mombasa yesterday also made a passionate appeal to the National Intelligence Service NIS, Ethics and Anti-Corruption Commission EACC and Director of Criminal Investigation to carry out thorough investigation to clarify the doubt in Kenyan minds that indeed there is corruption in the corridors of justice and money changed hands to influence the ruling in the petition in favour of Kidero.

Waititu said that he had fresh evidence indicating that Tunoi received Sh200 million to declare Kidero as the governor.

“The latest development as a result of revelation by an alleged middle man Geoffrey Kiplagat that he was a witness to a bribery scandal concerning my petition to the elections of governor Kidero is quite fascinating,” said Waititu.

He said everyone expects the CJ to come clear on the matter and convince people that the judiciary can handle elections, come out clear and show Kenyans that justice has been done to all.

The legislator said right now everyone knows that money changed hands and that 200 million shillings bought his victory and that of Nairobians.

“I want to appeal to the CJ that the chaos witnessed in 2007-2008 elections were as a result of people not believing the partiality of the judiciary,” said Waititu.

He opposed the presence of Professor Tom Ojienda an advocate for Kidero and member of the JSC to sit in a proceeding tomorrow because he was an interested party in the petition matter.

He said Ojienda had expressed his opinion that Kidero never bribed and therefore should be disqualified from the proceedings.

The MP said the CJ should restore the confidence of Kenyans in the judiciary system because the judiciary was under the public watch.

“The verdict read by justice Tunoi should be reviewed because everyone knows that under the influence of 200 million, he wouldn’t have gone otherwise than giving Kidero a win that he gave him,” said Waititu.

He said Nairobians deserved justice and to have been served a seat of governor to the leader they deserved through the votes.

Waititu told the CJ that the judiciary is on trial on public court and it was upon the CJ to restore the confidence of Kenyans on the judicial system.

“If it is true Tunoi received the money as alleged under oath, he should be arrested, convicted and his judgement be reviewed and nullified forth with,” said the MP.

He said in the event that Justice Tunoi is found guilty, then fresh elections should be called as it was the case of court of appeal.

Waititu said he would let Nairobians and people of Kiambu decide where he should stand as governor if the opportunity presents itself.

The legislature said that in the court of appeal Kidero was never validly elected together with his deputy and Kidero had moved to Supreme Court for a review of the judgement.

“If it is proved that the judgement by justice Tunoi was read under the influence of 200 million shillings, then we should go to the ruling of court of appeal that said gubernatorial elections be conducted afresh.
