TNA suffers blow as court nullifies nomination of 15 MCAs

The National Alliance (TNA) has suffered a blow in Nyandarua after the Court of Appeal nullified nomination of 15 members of the county assembly (MCA).

The affected include Rebbeca Nyangati, Tizzianah Wanjiru Mwangi, Teresiah Njoki Kamau, Rahab Wanjihia, Patricia Wanjugu, Nancy Wambui, Moses Mwichigi, Monicah Wamuyu, Magrete Wamuyu, Joyce Nyambura, Jane Muthoni, Dorcas Nyambura, Beth Wahito, Anne Waithera Kionero and David Mwangi alias Pele.

Delivering her ruling on Friday, presiding Judge Roselyn Nambuye cited various anomalies concerning submission of the final nominees' list.

The court further observed that the MCAs appointment was illegally done since the party failed to consider regional balancing, gender and people with special needs.

New list

The party has now been ordered to submit a new list to the Independent Electoral and Boundaries Commission (IEBC) within seven days for a subsequent repeat of the entire process.

The ruling was lauded by former councillor Esther Njogu, a constituent, Lydia Nyaguthi iand David Ndung'u who filed the case in court challenging the nominations.

Through their lawyers, Stanley Kihiko, the trio said MCAs nominated to represent youth, women and people living with disabilities were not representative of these groups.

Kihiko told the court that the nominee representative for people living with disabilities was not a person living with disability.

The lawyer also noted that regional balancing was not observed during the nomination process, saying the party failed to ensure that all five constituencies, Ndaragwa, Ol Jororok, Ol Kalou, Kipipiri and Kinangop were equally represented.

Way forward

He said Ndaragwa and Ol Jororok constituencies got three slots and the rest shared the remaining 13 slots.

Following the ruling, TNA County Secretary Ndegwa Wahome and the assembly speaker said the party would abide by the court's decision.

"We will meet as members, before the deadline expires, to chart the way forward," he told The Standard.
