Petitioner seeks to stop Sonko ouster

A man has sought the help of court to bar the County Assembly of Nairobi from debating the impeachment Motion against Governor Mike Sonko.

In court documents filed yesterday under a certificate of urgency, the petitioner is also seeking orders compelling the Assembly to expedite the vetting of Anne Kananu Mwenda as the Deputy Governor before the Motion is debated.

George Bush, the petitioner, filed the case at the Milimani Law Courts, where he argued that the grounds stated for Sonko’s impeachment were being tried by the anti-corruption court and if the Motion was allowed to be debated, Sonko risked suffering double jeopardy.

Mr Bush stated that the grounds of impeachment stemmed from the decision by Sonko to obey a court order, which barred him from accessing his office and that the impeachment charges only arose after he was barred from accessing the premises. He asked the court to declare that the impeachment Motion was against Articles 27, 47 and 49 of the Constitution of Kenya.
