The basis under which alcoblow was scrapped


 The three judges who ruled out that the use of alcoblow to curb drinking cited the following reasons as to why they outlawed the alcoblow.

First and foremost Justice Fatuma Sache, GBM Kariuki, and Festus Anzangala while delivering their ruling on Friday said that the law that introduced the alcoblow was illegal because it violated the Traffic Act.

Secondly, the three judges said that most motorists have different capacity to which they drink alcohol and get intoxicated. So each and every motorist must be faulted according to his intoxication capacity which the police didn’t have.

Thirdly the Judges said that the ordinary Kenyan was not consulted at the introduction of the device. That is it was never subjected to public participation.

On the other hand, some motorist blamed the police for using the device to extort money from motorist. The introduction of the breathalyser was in one way encouraging corruption among police officers.

Meanwhile, some people have faulted the move by the three judges saying that it will lead to many road accidents hence lose of life by drivers who drink and become incapable of having proper control of their vehicles.
