Process server accuses law firm of forgery

A court process server has written to Nanyuki Chief Magistrate demanding investigation into the activities of a law firm that he has accused of forgery.

Mr Josphat Gatheru noted that the law firm has on several occasions forged his signature and issued fake affidavits.

The letter was also copied to the Criminal Investigations Department and to the court process server committee chairman at the High Court.

The complaint came following sentencing of a woman, Ms Florence Wambui, to one-month civil jail after she failed to appear in court to answer to charges of failing to clear a debt.

The law firm had allegedly failed to serve her with summons.

Gatheru said: “On September 13, 2012, a certain man approached me claiming he will deal with me because I caused his wife, Wambui to be jailed since I failed to serve her with court summons.”

Gatheru also attached an affidavit of service letter, which was allegedly issued to Ms Wambui by the law firm.

The affidavit has his name and signature and it indicates he served it.

“I was alerted by another lawyer in Nanyuki after one of his clients raised a complaint,” he said.

The letter reads in part: “It came to my knowledge when J M Mwangi advocate called me over his client who protested, claiming I did not serve him with any of court documents in a civil matter before Chief Magistrate’s court in Nanyuki.”

The civil case between Mohammed Ali Gutale versus Kennedy Guantai Muthamia that was to be heard on October 11 has since been postponed following an application over the forgery.

Gatheru has requested that the matter be investigated with speed, arguing that his life was in danger because of the threats he is receiving.

Laikipia East OCPD Joshua Lutukai has confirmed receiving the letter, adding that investigation has been launched.
