Dennis Itumbi faults EACC, DPP for slow investigations in the Ruaraka Land Saga

Digital strategist Dennis Itumbi has faulted the Ethics and Anti-Corruption Commission (EACC) and the Office of the Director of Public Prosecution (DPP) for slow investigations in the Ruaraka land case.

He wants the investigations into the Ruaraka Land saga completed in the next one week.

Itumbi has written to the DPP and EACC, demanding the prosecution of Former Interior CS Fred Matiang'i alongside others.

In a letter dated February 9, Itumbi (through his lawyers) has faulted the two institutions for dragging the investigations and failure to prosecute the former CS.

"We demand, which we also hereby do, that within the

next coming seven (7) days you inform us on the progress your Commission has made in its additional investigations implicating the above-named individual and the other culprits," the letter reads in part.

According to Itumbi's communication. this is the second time he is writing to the graft mitigation agency and the state prosecutor over the involvement of Matiang'i in the Ruaraka Land saga.

"Our client informs us that by your letter dated 8th October 2020, you responded to him and stated that you would respond to the issues raised in "due course"," he says.

"In his response by a letter dated 14th October, 2020, he sought clarification on how many days the Commission had in mind when using that phrase. We attach the said letters for ease of reference,"

According to Itumbi's lawyers, the prosecution was halted when the file was returned to the EACC. The Commission was asked to provide more evidence on three different occasions.

"The directions which saw the investigative file returned three (3) times were that you include officers from the Directorate of Criminal Investigations, Land Fraud Department in the case in order to have a water tight evidence against the 26 culprits who were to be charged, Dr. Fred Matiang'i being amongst them,"

Itumbi is accusing Matiang'i of being the mastermind behind the illegal acquisition of a 13-acre piece of land where Ruaraka High School and Drive Inn Primary School sit.

The land, according to Itumbi, already belonged to the state and the compulsory acquisition by the then Ministry of Education then led by Dr. Matiang'i was irregular and Kenyans ended up losing money in the process.
