Voters petition CJ Mutunga over Bichage poll petition

Voters from Nyaribari Chache constituency have protested over delays in determination of an election petition by Chris Bichage that is pending at the Supreme Court.

In a petition to the Chief Justice Willy Mutunga, the 24 voters faulted the Judiciary over the delay in hearing the petition, a year after it was filed.

“We pray that you intervene and ensure the hearing date is set, and further ensure that the matter is heard and determined expeditiously,” reads parts of the petition.

The voters complained that their rights have been violated  and appealed to Dr Mutunga to ensure it is heard and the verdict delivered soonest.

The High Court nullified Mr Bichage’s election on grounds that the validity of his victory could not be verified due to the absence of statutory documents and irregularities in three polling stations within the constituency.

The matter has been mentioned a record twelve times, the latest being on July 2 but no hearing date has been set.

“Despite public pronouncement by yourself that such matters be concluded expeditiously, the Nyaribari Chache petition has neither gone to full hearing nor do we have a hearing date,” the voters said.

The delay, they said, was a travesty of justice and is contrary to reforms.
