Mututho fraud case to be heard on Thursday

Nairobi County: The Sh41.2 million fraud case against former Naivasha MP John Mututho, which has been in court for more than eleven years, will finally be heard on Thursday.

The case that was supposed to be heard on Tuesday was postponed due to failure of the prosecutors’ witnesses to appear before the court.

George Kithi, the lawyer for Mututho , urged the court to withdraw the case as the accusers’ witnesses have not appeared in court for all the sessions.

State prosecutor Emily Kamau told the court that the documents from the Registrar of Companies were not ready and asked the court to adjourn the case.

Mututho was accused in 2001 of obtaining Sh41.2 million from Kenyatta National Hospital (KNH) by pretence.

He faces further charges of presenting a forged receipt to Alice Nungari Kidinga of KNH, alleging it originated from the Kenya Revenue Authority for payment of import duty and VAT of Sh5.1 million.

Ms Kamau successfully applied for warrants of arrest for two witnesses from KNH who had failed to appear before the court thrice despite being served with summons to do so.
