A woman charged with stealing a six-month-old baby will remain in custody until her case is heard and determined, a Nakuru court has ruled.

Senior Resident Magistrate Benjamin Limo ruled that Esther Nyaituga was a flight risk after considering the pre-bail report filed in court.

According to the report, the mother of the baby was still in fear that if the accused was released, she will flee or attempt to steal her baby again.

“The baby’s mother fears for her life and her baby’s. She claims that the accused threatened to cut her finger off,” reads the pre-bail report.

The report also read that the accused’s life was at risk since her neigbours knew her and would attempt to lynch her over the same.

The report concluded that the accused was a flight risk, she had no permanent place of abode and was a threat to the family and the baby.

“For benefit of the victim, the report recommends that the accused be denied bail.”

Mr Limo agreed with the report and denied the accused bail. He however said that the case will be heard on priority basis.

The case will be heard on March 24 and 25.
