Wiper Democratic Movement nominated MP Robert Mutemi Mutua will retain his seat, the High Court ruled yesterday.
Justice Isaac Lenaola concluded that any challenge to the nomination of an MP could only be done by way of an election petition and not a constitutional petition. He said the High Court had no jurisdiction to declare the position Mr Mutua holds vacant.
