Machakos Governor Alfred Mutua has lost a bid to stop Ethics and Anti-Corruption Commission from summoning him in relation to alleged fraud in purchase of vehicles for the county.

Justice Isaac Lenaola, while delivering the ruling yesterday, said Dr Mutua failed to prove that he will suffer any prejudice if he appears before the commission.

“I do not find that the petitioner will be prejudiced in any way by failure to have the orders sought,” said Lenaola.

He said Mutua has failed to show how his right to fair trial has been compromised in the circumstances because he has already enjoyed the conservatory orders and failed to pursue his petition.

Lenaola said the EACC had, through a letter dated June 17, invited Dr Mutua and his deputy to appear before the team to be interviewed and record statements on June 26.
