KMPDC officer charged over Sh30 million SHA fraud scheme, freed on Sh8 million bond

[Micah Nyandoro, Standard] An employee of the Kenya Medical Practitioners and Dentists Council (KMPDC) has been charged before a Nairobi court over an alleged Sh30 million fraud scheme involving irregular registration of health facilities and fraudulent claims paid by the Social Health Authority (SHA). Harun Liluma was arraigned on Friday before Teresia Nyangena at the Milimani Law Courts, where he denied multiple criminal charges contained in eight files filed by the Office of the Director of Public Prosecutions (ODPP). The charges include conspiracy to defraud, abuse of office, unauthorised access to a computer system, and irregular facilitation of registration of health facilities, offences said to have been committed between January and August 2025. In one of the files, Liluma is jointly charged with Ismail Omar Mohammed, the owner of Julun Nursing Home. [Micah Nyandoro, Standard] Prosecutors told the court that the two, together with others not before the court, conspired to fraudulently procure the registration of Julun Nursing Home, which later enabled the facility to be contracted by SHA and receive payments amounting to Sh1.9 million. "On diverse dates between January 30, 2025, and August 21, 2025, within the Republic of Kenya, jointly with others not before the court, the accused persons conspired to fraudulently procure the registration of Julun Nursing Home by unlawful means, leading to its contracting by the Social Health Authority and payment of Sh1,955,548.98," the charge sheet states. Liluma, who was the only accused person present in court, also faces a separate charge of unauthorised access to the KMPDC computer system. Prosecutors allege that between January 30 and February 1, 2025, he unlawfully accessed the council's rHRIS/THRIS system and altered records, knowing that such access was unauthorised. In another count, the court heard that Liluma, while serving as a public officer, abused his office by irregularly facilitating the registration of Julun Nursing Home contrary to statutory requirements, an act the prosecution says was prejudicial to public interest. He further denied charges of irregularly facilitating the registration of several other health facilities, including Adfaal Kids Care Medical Centre Limited, Danaba Care Hospital, Dimtu Nursing Home Limited, and Mama Nerbeel Nursing Home. The alleged beneficiaries of the irregular registrations include Mohamed Mohamud Sheikh, Ali Ahmed Adan, Mohamednoor Ismael Omar, Naima Sheikh, Abdihakim Sheikh, and Adan Abdullahi, who are listed as co-accused persons in the matter. Following his plea, Liluma's lawyer urged the court to allow his client to remain in protected custody at Muthaiga Police Station, citing fears for his safety if remanded at Industrial Area Prison. "My client fears for his life if taken to Industrial Area Remand. We pray that he be held under protected custody as investigations continue," counsel submitted. However, the prosecution opposed the request, telling the court that the defence had failed to demonstrate any real threat. "There is no evidence placed before this court to show that the accused person's life is in danger. The State assures the court that the accused's safety can be guaranteed," the prosecutor argued. In her ruling, Magistrate Nyangena ordered that Liluma be released on a bond of Sh8 million with a surety of a similar amount. Alternatively, he may post a cumulative cash bail of Sh4 million with two contact persons. The court further ordered that Liluma be remanded in Industrial Area Remand Prison custody pending compliance with the bond terms. Warrants of arrest were also issued against the other accused persons, including the owners of the health facilities, who failed to appear in court for plea taking The cases will be mentioned on March 12 for further directions.
