By ratifying the Convention on the Elimination of All Forms of Discrimination against Women in 1979, Kenya committed to advancing gender equality by confronting any peculiarity, exclusion, or restraint made on the basis of sex which prejudices the enjoyment or exercise of women of human rights and fundamental freedoms.
Article 10 of our Constitution contains the national values and principles of governance which requires the State under Article 27(6) to take legislative and other measures, including affirmative action programmes and policies, designed to redress any disadvantage suffered by individuals or groups because of past discrimination. Since the enactment of the new Constitution in 2010, Kenya has experienced a harbinger of women occupying high-flying public positions, including Chief Justice Martha Koome and women governors.
