Voter moves to High Court over IEBC report

A resident of Kiharu Constituency is seeking to stop the adoption of the report by Interim Independent Boundaries Review Commission (IIBRC) as the exclusive material in creating boundaries.

Mr Kiiru Mwangi is asking the court to issue an injunction restraining the Independent Electoral Boundaries Commission (IEBC) from relying on the Ligale report alone in regard to delimitation of boundaries and wards.

In the suit against IEBC and the Attorney General, Mwangi argues that the commission has released a preliminary report as a consequent step towards delimitation of boundaries and establishing electoral units.

He claims the commission has entirely adopted the Ligale report as a primary source without carrying out its own independent review process, as required by the Constitution.

The IEBC, he further argues, is about to undertake a crucial exercise — review and delimination of boundaries — without adhering to the due process.

The Ligale report, he claims, is tainted and unatenable in law and against public interest.

"The mandate bestowed upon the commission in respect of delimitation of constituencies and wards using appropriate timelines and methodology is on the verge of being eroded by the actions of the commission," he argues.

Justice G B M Kariuki will today decide whether to issue the temporary injunction. He will also decide whether to issue conservatory orders in favour of two voters —Mr Charles Omanga and Mr Patrick Njuguna.
