Ken Okoth's wife, girlfriend agree to end DNA row

The widow of Ken Okoth has entered a consent with Nairobi MCA Anne Thumbi over her son's DNA results to end a dispute at the High Court.

Monica Okoth, Okoth's mother Angeline Okoth and Thumbi yesterday filed an agreement to settle the matter at the Milimani Commercial Court.

In a consent filed on Tuesday by all lawyers, Monica and Okoth's mother alongside Thumbi requested the court to mark the matter as closed.

They said other issues would be dealt with by the High Court in the probate and administration division.

Monica had on September 18 requested to be granted more time to produce her DNA results, saying she might have different results.

Property administration

Thumbi’s lawyer Elkana Mogaka had asked the court to close the case based on the available DNA results, and let the parties proceed to family division to file a property administration case.

“DNA results indicate that Thumbi's son was sired by late Kibra MP and therefore he is entitled to inherit his father’s property,” said Mr Mogaka.

On September 5, lawyer Danstan Omari and Mogaka had filed the results that confirmed that the late Okoth was the biological father of Thumbi's son.

The lawyers indicted the tests were conducted in three hospitals – local and international.

Documents indicated that DNA results were 99.99 per cent accurate.

Thumbi had sued Okoth’s mother, widow and Lee Funeral Home to stop former MP's burial. She wanted her son to be recognised as Okoth's son before the send-off. Okoth was, however, cremated.

The magistrate's court had temporarily barred Okoth's kin from conducting burial or cremation.
