All candidates were satisfied with results, petitioner told

Vihiga County Returning Officer Sarah Ogaro has told the court it is not a legal requirement for the presiding officers and their deputies to sign and stamp statutory forms.

Ms Ogaro, however, said it is an administrative requirement by the Independent Electoral and Boundaries Commission (IEBC) to stamp the forms used for various elections.

During a cross examination in the petition challenging Vihiga Governor Wilbur Ottichilo's win, the returning officer said the petitioner filed misleading figures in court.

“There is no candidate who lost in the last election who has filed a petition challenging the exercise conducted on August 8. This shows they were satisfied with the results and the declaration of the winner,” said Ogaro.

A voter, Hamza Musundi, moved to court challenging the declaration of Ottichilo as the poll winner his evidence was challenged by lawyers Khayega Chivai and Geoffrey Sore who are representing the governor.

Musundi argues that Ottichilo influenced the IEBC staff during the polls day, claims he failed to substantiate in court when asked to do so.

The lawyers representing Ottichilo accused Musundi of deceiving the court when a lot of inconsistencies emerged in his case.
