DPP seeks more time to probe children’s killing

The prosecution has sought more time to investigate the killing of Kapsoya MAC aspirant James Ratemo’s three children.

Senior Assistant Director of Public Prosecutions Zachary Omwenga asked court for ten days before preferring more charges against the key suspect, Mr Enoch Onsanse.

Onsanse was charged before Chief Magistrate Charles Obulutsa, on May 17, with abducting Clifford Nyambane, 6, Taniy Nyamweya, 5, and Glen Ongaki, 3 on May 13 from their Kapsoya home as they headed to church.

Omwenga said they want to properly investigate the killings before amending the charges. The prosecution sought to amend the initial charges to murder after it emerged the children were killed.

“We want to investigate three key issues before we drop the abduction charges and probably place murder charges if that is what the investigations will reveal. The children lived in Uasin Gishu yet their bodies were found in Trans Nzoia, where proper investigations need to be done. Some forensic tests also need to be done in Nairobi hence we need more days to conclude the investigations,” said Omwenga.

Obulutsa did not object to the request. The case will resume on June 6 when the prosecution is expected to place formal charges based on its investigations against Onsanse who is Ratemo’s younger brother.

“We understand the matter is of great public interest keeping in mind three innocent children were killed. That is why we need thorough investigations. We need to know who to charge because we suspect the acts were done by more than one person. We are building a strong case so that the public can be sure nobody can take away life and walk free,” Omwenga later told the press.

Omwenga said the prosecution is not ready to rush the case then lose. He said when they return to court, they will be able to prefer appropriate charges against the suspect.
