Reprieve for Unilever on Aromat as court stops ban of the product

NAIROBI, KENYA: The High Court has ordered National Bio-safety Authority not to arrest Unilever Kenya Limited directors for allegedly contravening importation regulations. The authority has also been stopped from recalling Aromat products from the market on grounds that they contain Genetically Modified Organisms (GMOs), until the matter filed by Unilever is heard and determined.

High Court Judge Isaac Lenaola ordered that the authority should not arrest or institute criminal proceedings against the directors for allegedly not adhering to bio-safety regulations while importing Aromat.

The court heard that in the last one week, the National Bio-safety Authority has been collecting Aromat samples with the effect of disapproving it as being unsafe for consumption. The product is alleged to contain GMOs, which are barred in the country.

In the case filed before Justice Lenaola, Unilever argues that despite the Cabinet's decision on GMOs, there is no gazette notice banning the use of the products in Kenya, adding that there is no law existing in the country on the same.
Lenaola ordered that Unilever serves the Attorney General and the authority and go back to court on 15th of this month.
