Kimilili businessman in student murder case denied bail

The Kimilili businessman facing charges of allegedly killing a university student has been denied bail.

Henry Waswa is accused of killing Mitch Kibiti, son to Bungoma Education Chief Officer David Kibiti, after a disagreement at the Etonia Club in Kimilili.

Waswa, who had appeared before judge Alfred Mabeya two weeks ago, denied the offence and asked for bail pending the hearing of the case.

However, the prosecution through Onyango Oimbo objected Waswa's bail application, saying he evaded arrest for almost a week and has several other court cases in which he had threatened witnesses.

Delivering his ruling on the bail application yesterday, Justice mabeya said although the Constitution had given an accused person the right to bail, it had limits.

"Although the same Constitution does not specifically point out this circumstances, I find the grounds by the prosecution sufficient and hereby deny the accused bail until the end of the trial," said Mabeya.
