Boinnet ordered to summon State House official

Inspector General of Police Joseph Boinnet has been ordered to personally serve court summons to State House comptroller Lawrence Lenayapa.

Naivasha Chief Magistrate Peter Gesora issued the orders for Mr Lenayapa to appear in court in a case facing MPs Alfred Keter and Sonia Birdi.

This was after the court was told it had become impossible for the prosecution to access State House to serve the comptroller.

Lenayapa is one of the key witnesses in the case where the MPs have been charged with different counts, including creating a disturbance at the Gilgil weighbridge on January 24, 2015.

The legislators are also accused of using unprintable words while demanding the release of a trailer which had been impounded for breaking the law.

While making the application, Senior Assistant Director of Public Prosecutions Njagi Nderitu told the court that their bid to serve the State House comptroller had hit a wall.

He said their attempts to access State House had not borne fruit, adding that the IG, who is a regular visitor there, could do better.

During the hearing of the case, a police officer admitted recording the video clip which caught the two MPs issuing threats.

Constable Isaac Mukonabi, who was then stationed at the weighbridge, told the court that Keter at one point nearly beat up the duty manager.

The officer said that he decided to record the altercation for 'fun' before posting the footage on his Facebook account where it went viral.

Mukonabi told the court that during the incident, the two MPs threatened the entire staff that they would be sacked for detaining the truck.

The witness was however stepped down until November 30 this year when his video recording will be played in the court.

During the hearing of the case, the MPs' lawyer Okong'o Omogeni took issue with the allegedly signed contract between SGS Company manning the weighbridge and the Government.
