Call to overhaul Supreme Court timely

Recent calls for reconstitution of the Supreme Court by both President of the Law Society of Kenya (LSK) Eric Mutua and Majority Leader Aden Duale were spot on.

This comes at a time when the Supreme Court is embroiled in power succession struggles, corruption web and row on mandatory retirement age for judges.

With Chief Justice Willy Mutunga opting to retire this year, those eyeing the seat have began scheming to succeed him.

Embattled Supreme Court judge Philip Tunoi who is facing corruption allegations has cited power succession as the cause of his predicament.

Reports indicate that a week before Justice Tunoi was hit by the bribery bombshell, Dr Mutunga had invited the Ethics and Anti-Corruption Commission (EACC) and the Auditor General to conduct a lifestyle audit on judicial officers starting with himself. This could have been Mutunga's way of hinting the rot that persists in the Judiciary.

Should the damning bribery allegations surrounding Justice Tunoi turn true, then a complete overhaul of the Supreme Court will be inevitable.
