Former nurse accused of raping patient now sues DPP and KNH

The Director of Public Prosecutions (DPP) and Kenyatta National Hospital (KNH) have been sued by a nurse who was suspended over allegations of raping a patient.

Andrew Khisia Wasike wants the DPP and KNH compelled to produce in court an investigation report compiled after his arrest.

"My client ought to be supplied with the said report since it is his constitutional right to know the outcome of the circumstances that led to his arrest and suspension from employment," his lawyer Ilam Lagat told the court.

Mr Wasike was arrested on June 13, 2013, and held at Capital Hills Police Station where he recorded a statement before being released.

The applicant, through his lawyer, told the court that he was questioned by the police and released on bond, but charges were never brought for lack of evidence.

The lawyer told Justice Weldon Korir that his client was absolved by the Nursing Council of Kenya upon conducting its own investigations.

The matter will be heard on September 24.
