Registrar enjoined in Wiper MP ouster case

A court case seeking the ouster of Wiper Democratic Movement's nominated MP Robert Mutua has sucked in the Registrar of Political Parties with the High Court ordering that she be enjoined.

Justice Isaac Lenaola directed David Muriuki, a voter, to serve Lucy Ndung'u with the suit papers in a case in which he wants the nomination of Bishop Mutua revoked.

Monday, the party's lawyer Steve Mogaka told the judge Mutua's nomination was a mistake that Wiper seeks to revoke. "From the records available to the party, he has never been a member of Wiper since its formation. This matter can be determined with the registrar of political parties," Mogaka said and asked for 21 days to prepare.

But lawyer Wilfred Nyamu for the MP told the court that he "will lay everything bare" at the hearing of the case to prove that Mutua was validly nominated.

Nyamu said his client is a member of the Kalonzo Musyoka-led party. "This is pure politics at play as election petitions were determined almost a year ago and nobody challenged Bishop Mutua's nomination," he argued.

The case is to be heard on December 8.
