Attorney General Githu Muigai seeks nod to reply to governors

Attorney General Githu Muigai has asked the High Court to allow him respond to a suit by governors over county roads.

The governors are demanding that the Government transfers the role of repairing county roads to the devolved units.
Githu, through his lawyer Mwangi Njoroge, asked Justice Mumbi Ngugi to give him seven days to file a cross petition, saying the Government would table its grievances relating to the demand after earlier negotiations failed.

Njoroge said governors together with Kenya National Highway Authority, AG, Kenya Urban Roads Authority and the Transition Authority had been directed by Justice Isaac Lenaola to dialogue on how to settle the matter out of court but the meeting convened last week did not bear any fruits. "We pray that the court grants us seven days to file a cross petition," he said.

The AG had already filed grounds opposition to the case, saying the proceedings were contrary to the spirit of the Constitution. The court heard the Government had already procured engineers to repair the roads. The matter will be heard on Monday next week.
