Budalang’i and Malaba residents will continue trekking for miles to seek justice at the Busia Law Courts as it has been the case for more than two decades due judiciary staff shortage of staff and incomplete buildings for the gazetted courts in Malaba and Port Victoria.
Busia county Law Society of Kenya chair Joseph Makokha blamed the shortage and incomplete building designated for the Malaba court for the delayed provision of judicial services to locals.
Speaking to Standard Digital on Saturday, Makokha observed that even the Busia Law Court is currently understaffed due to shortage of magistrates and prosecutors.
“At the moment, there are five prosecutors serving six courts and with this reality,” he said adding that it will be impossible for the same prosecutors to serve Busia Law Courts, Port Victoria and Malaba Law Courts.
He said the situation has forced offenders from Budalang’i and Malaba to be transported to Busia Law Courts daily.
“Our clients reach Busia Law Courts between 10am and 11am daily and that is why it is necessary for courts to be established near them but they may not benefit from court services near them any time soon,” said Makokha.
During a visit to Busia Law Courts on Thursday, LSK President Nelson Havi urged the judiciary to consider recruiting advocates as prosecutors to serve members of public seeking justice in courts.
He met High Court Judge Kiarie Waweru, Chief Magistrate Lucy Ambasi and a battery of lawyers.
Havi at the same time reiterated that Members of Parliament will be illegally in office after October 12.
He called on Kenyans to hold to account their legislators who will still be in office after October 12 and demonstrate to have them recalled.
Havi wants President Uhuru Kenyatta to abide by Chief Justice David Maraga’s advisory to dissolve parliament for failing to implement the two-thirds gender rule, noting that Attorney Paul Kihara and the parliament erred by suing the CJ over his decision.
“We are calling upon members of the public to hold their MPs accountable. They need to be held accountable because we said that effective October 12th they will be in the office, therefore, they will have no right of whatsoever to continue serving as representative of the people,” the LSK President said.
