Kadhis Court Ruling

The high court in Mombasa has struck out a case against the inclusion of Kadhis courts in the proposed constitution. Its ruling said the high court has no mandate on referendum matters. Three clerics had sued Attorney General Amos Wako, committee of experts Chairman Nzamba Kitonga and the chairman of the parliamentary select committee for allegedly contravening their fundamental rights by favouring one religion over others. This ruling comes barely a week after a three-judge bench sitting at the Nairobi high courts ruled that the inclusion of the Kadhi’s courts in the current constitution is discriminatory.
