16 - The Standard

Teams from the Judiciary, Raila Odinga and Uhuru were locked up in scrutiny of the electoral system following a directive by the seven-judge bench. Below is an excerpt of the report on some 16 issues that were addressed. 1. GPRS location of each Kiems Kit used during the elections, between August 5 and 11. IEBC only provided the GPS locations for the polling stations and not the kits as directed by the Supreme Court. All parties including agents for both Presidential candidates and the IT experts demanded the correct report which was never availed. Kenyatta's agents. 2. Certified list of all Kiems kits procured but not used or deployed during the elections IEBC provided the required report in a spreadsheet to the satisfaction of agents for both candidates. It experts appointed by the Supreme Court cautioned that while a response was given by the IEBC, it the information was not comprehensive. 3 Polling station allocation for each Kiems Kit used during the elections IEBC provided a report in a spreadsheet that was accepted by agents of both parties and the IT experts. 4 Technical Partnership Agreements for the IEBC Election Technology System including but not limited to, a list of technical partners, kind of access they had and the list of Application Programming Interface (APIs) for exchange of data with partners. IEBC provided agreement, list of partners, link of the API and the list of media houses invited to access the API. Odinga's agents were not satisfied with the information provided, and request for a list of all APIs. IT experts said the request made were not clear since the list of APIs. Kenyatta's agents were satisfied with the document. 5 Log-in trail of users and equipment into the IEBC servers IEBC provided pre-downloaded logs in a hard disk. Odinga's agents disagreed with the softcopy logs provided, requesting for access into the system to download the logs. Agents for President Kenyatta claimed there was nothing wrong with the logs provided as they would serve the intended purpose. It experts disagreed with IEBC indicating that the electoral body was supposed to demonstrate the source of the logs by allowing the parties access into the system. Live access into the system was granted much later on August 29 at 3.15 pm but without the ability to view or access the logs. In effect, IEBC defied the Supreme Court of this ruling. 6 Log in trails of users and equipment into the Kiems Database Management System IEBC again provided pre-downloaded logs in a hard disk. Odinga's agents turned down the pre-downloaded logs, requesting that the logs be accesses from the servers as they watched. As 2would be expected however, Kenyatta's agents were just fine with the pre-downloaded logs. Supreme Court's IT experts said that the IEBC had ignored the directives given by the Judges by refusing to offer live access to the Kiems Database management System. 7 Log in trails of users and equipment and administrative access log in to IEBC portal since August 5 IEBC provided a pre-downloaded list of logs in a hard disk, which was refuted by the It experts and Odinga's agents who requested live access. Denying access into the system and portal was in contempt of court, the experts noted. Kenyatta's agents were satisfied with the pre-downloaded information. 8 How many servers did IEBC have exclusively possession of? IEBC provided hardcopy and softcopy documents Raila Odinga was not satisfied with the information provided, requested for more. Agents for Jubilee agreed with the information provided. IT expert said the information provided was sufficient. 9 Firewalls without disclosure of the so0ftware version IEBC was unwilling to provide the configuration of the internal or external firewall Odinga's agents demanded the configurations of the firewalls Kenyatta's agents argued granting configuration of the firewalls would compromise the security of the system. IT experts denied the claim that sharing the configurations of the internal firewall would render the system vulnerable. However, the experts agreed that the configurations for the external firewall could compromise the system. IEBC nonetheless refused to provide the configurations. 10 Operating systems without releasing the software version IEBC provided the software version in hardcopy Odinga's agents acknowledged receipt of the software version but requested for additional information. Kenyatta's agents said the information provided was sufficient, a position shared with the IT experts. 11 Password policy IEBC provided the policy in softcopy. Agents for the candidates acknowledged receipt of the policy while the IT expert said the information provided was sufficient. 12 Password matrix IEBC provided the passwords matric in softcopy which was agreed on by all the parties including the IT expert. 13 System user types and levels of access IEBC provided the response in softcopy to the satisfaction of all parties. 14 IEBC Election Technology System Redundancy Plan comprising its business continuity plan and disaster recovery plan. All parties satisfied with the information provided by the IEBC 15 Certified copies of the certificates of Penetration Tests conducted on the IEBC Election Technology System prior to and during the elections. IEBC provided test reports. Odinga's agents said test reports provided were not certified hence ineligible, a position agreed on by the IT experts. Kenyatta's agents said it was a small matter as the reports could be certified at any time. 16 Certified copies of the certificates on penetration tests done by professional IEBC provided the certificates in hardcopy. IT experts agreed with Odinga's agents that the certificates ineligible as they had not certified as required in law. Kenyatta's agents indicated that certification was a small matter that could be done by IEBC at any time. Conclusions made by the two IT experts, Prof Elijah Omwenga and Jose Sevilla, and Janet Kadenyi- an ICT officer of the Judiciary. IEBC had agreed to provide Read Only live access to the servers at 11 am on August 29, but only provided the access at 3.15pm. Agents and the experts could however not copy and download any of the required logs. IEBC claimed it was facing technical challenges in complying with the access as directed by the judges.
