Waluke has case to answer in Sh297 million fraud case

Sirisia MP John Waluke (pictured) has a case to answer in the Sh297 million maize fraud case, the court has ruled.

Magistrate Elizabeth Juma sitting in Nairobi ruled that Waluke and his two co-accused have to defend themselves on charges arising from dealings with the National Cereals and Produce Board (NCPB).

The court also put Waluke’s co-accused, Grace Sarapay Wakhungu and Erad Supplies and General Contracts Limited, on their defence.

The court heard that Waluke and Wakhungu, being directors of Erad Supplies and General Contracts Limited fraudulently uttered a false invoice for $1,146,000 (Sh115, 061,838) as evidence of an arbitration dispute between their company and NCPB.

“On or about June 27, 2013 in Nairobi City County within Nairobi in the Republic of Kenya, being the directors of Erad Supplies and General Contracts Limited jointly and fraudulently acquired public property worth Sh13, 364,671.40 purporting to be costs for storage of 40,000 metric tonnes of white maize purportedly incurred by Chelsea Freight,” read the charges.

The legislator was also charged with fraudulently acquiring Sh297 million as the cost of storing the maize.

The court heard that Waluke and Wakhungu made the contested invoice in support of alleged storage costs.

 The case will be heard on June 13, 2019.
