Father and son defiled minor, DNA results reveals father of teenager's four-month-old child

A 52-year-old man, who was arrested and charged with defiling and impregnating a minor, told court it was the devil that led him to the act. Silus Lumiti while taking plea before Senior Resident Magistrate Noileen Akee  confessed to having carnal knowledge with the minor for two years.

Lumiti said there were diabolic forces pushing him into the act especially during the period when his wife left for overnight prayers popularly known as ‘Kesha’. He said despite his wife being prayerful, there were spirits pushing him to commit the act.

Lumiti pleaded guilty to the charge of defiling and impregnating the teenager after he was furnished with copies of DNA test, which positively identified him as the biological father of the minor’s four-month-old son. The suspect was meant to take plea two weeks ago, alongside his 19-year-old son Denis Ashivaka but it was defered because results of the paternity test were still not known.

Apparently, the minor, a pupil at a local primary school did not know who the father of her son was since she was defiled by both father and son.

The minor was forced to have sex by Lumiti during the night while his son pounced and defiled her during the day when his father was away. But a DNA test, conducted by a government analyst Polycarp Lutta, at a laboratory in Kisumu, indicated there were 99.99 chances Lumiti being the child’s father. The test also confirmed Lumiti was the biological father of the second accused Denis Ashivaka.

Emotions ran high when State Prosecutor Melisa Lukulu narrated to the court how the suspects abused the minor, who had sought refuge in the homestead, after her father, now deceased could not meet her needs. Upon hearing the confession, Lumiti’s wife collapsed.

In 2016, the minor only referred to as JE went to stay with her grandmother in Ileo, Shinyalu constituency where she was to be enrolled in school. JE’s father, struggled to fend for his daughter after his wife left him. It was at that point that he sought help from her daughter’s grandmother. Lumiti began defiling the girl when her grandmother went for evening prayers.

Lumiti’s son also forced the minor into a sexual relationship. When the complainant realised she was pregnant, she informed her grandmother. During the burial of the minor's father, villagers threatened to lynch Lumiti's and his son before police from Shinyalu arrested them.
