State wants terror suspects denied bail

The Government has maintained that there is sufficient evidence to deny four terror suspects bond.

Principal Prosecution Daniel Wamosa on Thursday told Mombasa Principal Magistrate Francis Kyambia that Nargis Arafat Gulam, Emilia Lukas Antony, Saumu Ali Athman and Mohamed Ibrahim Noor, who were arrested at Mtwapa bridge in Kilfi County last September enroute Garissa to meet Al Shabaab operatives, should not be released on bond because their accomplices are still at large and could sneak them out of the country.

“The accused should not be released on bond because some of their accomplices are still at large and will sneak them out of the country to Somalia,” said Wamosa.

The suspects have, however, denied that on September 16, 2015 they were discovered to be members of Al Shabaab.

Wamosa was opposing the accused’s lawyers Chacha Mwita and Jared Magolo, who renewed their application to have them released on bond following change of circumstances which made them denied bond when they first appeared in court last year.

Chacha, however, insisted that his clients should be granted bail because the witnesses the prosecution feared would be interfered with, had already given their testimonies.

“Since the prosecution has called all their witnesses they feared the suspects would interfere with there is no reason why accused should be denied bond because the circumstances under which the request was made has changed,” said Chacha.

However, Wamosa vehemently opposed the request and expressed fear that the suspects’ accomplices, including the mastermind of the journey to Somalia, Ms Fatma Gulam Nabil, would help them be sneak out of the country.

Anti-Terror Police have described Fatma as a dangerous woman with fictitious names. She is said to have flown to UK on September 16, 2015 using Xalima Mistri after giving the suspects a red bag to hand over to Shaban Musa Ramadhan, a Tanzanian who escaped while under police surveillance after serving a two-year jail term.

Fatama is wanted in connection with terrorism charges in Mombasa.

Police recovered a red bag containing a laptop, a surveillance pen, military boot, satellite phones, external hard disk and ear phones when she was arrested.

The bag was to be handed over to Shaban Musa Ramadhan.
