Woman jailed for refusing to swear in rape case

A woman will serve seven days in jail after she refused to swear before testifying in a defilement case.

The witness was to testify in a case Edward Mburu Kanyi is accused of defiling her seven-year-old daughter on December 28, 2014 in Piave Farm in Njoro.

She told Senior Resident Magistrate Judicaster Nthuku that her religion does not allow swearing by the Bible.

The witness further stunned the court when she refused to use the alternative - affirming that indeed the accused committed the offense - saying her religion condemns the act.

She had earlier been locked up for three hours before being sentenced. The case will be mentioned on June 22, 2016.
