Narok man could spend 10 years in jail for stealing Sh38,000 bull

Ten years is how long a man accused of stealing a Sh38,000 bull could remain behind bars if his appeal is thrown out.

John Oloiloli Musere, 24, appealed to the Kisii High Court to reduce his jail term of 10 years imprisonment.

He was charged with the offence of stealing a stock according to section 278 of the penal code. He committed the offence on May 11, 2015 in Ngutoto village, Trans Mara Sub County, Narok County.

The appellant had pleaded guilty to the charges of stealing a cow in the lower court under a resident magistrate.

“The sentence was too harsh, the trial magistrate did not grant me fair sentencing to allow me to assist my family who are suffering due to insecurity and lack of food since am the breadwinner,” said the appellant.

The accused is said to have taken a bull from the grazing field leaving behind his donkey.

He was also seen by a neighbour who called the complainant to ask whether he had sold his cow because he had seen it with the accused.

The resident magistrate, Monicca Munyondo, requested a social background report on the accused.

The accused was remanded at Kisii Police Station awaiting the report and later sentenced to 10 years in prison.

He was charged with a similar case, number 1356 of 2015, but the case was terminated.

His appeal will be heard on July 6, 2016.
