Governors to go to court over Transition Authority term

Governors will go to court if the Government extends the tenure of the Transition Authority (TA) whose term constitutionally ends on March 4.

Council of Governors (CoG) Chairman Peter Munya termed extension of TA officials' term in office as "an attempt by the Government to continue exercising illegal influence on the devolved units".

Speaking in Buuri constituency, Mr Munya, claimed that TA no longer had any role to play, as the devolved units had come of age after almost four years of existence.

He said the Government must use the remaining time to the end of TA's term to transfer all functions that are supposed to be devolved.

TA has asked the Government to consider an extension of its term to enable it shepherd the transfer of the remaining functions to the counties.

Munya said those supporting the extension of the term of the authority chaired by Kinuthia Wamwangi were only interested in stifling devolution.

"We shall not engage in any arguments about the extension of TA's term by March 4. They should prepare for a court battle," said Munya.

"Senators such as Kimani Wamatangi did not really know what they were talking about," said Munya. "We doubt they have read and grasped the law governing the terminal agency."

The CoG chair said counties were seeking for the transfer of Class D and below roads and not highways in Class A and B as claimed by some quarters.

He said counties last year won a legal case in which they were demanding the transfer of the roads under the Kenya Rural Roads Authority and Kenya Urban Roads Authority.
